Florida files antitrust suit against NCAA over name, image and likeness disputes

TALLAHASSEE, Fla. – Florida Attorney General Ashley Moody filed an antitrust lawsuit Wednesday against the National Collegiate Athletic Association after the organization accused the University of Florida and Florida State University of violating name, image, and likeness, or NIL, guidance.

According to Moody, the violations came after the NCAA published a series of posts on “X” updating its name, image, and likeness, better known as “NIL,” policy.

“It appears no one could ever comply with these ever-changing and unfair regulations that limit the ability of student athletes to negotiate in good faith,” Moody said. “I am taking legal action to reverse the unlawful restrictions the NCAA has placed on Florida universities and our collegiate athletes.” 

Moody also urged the NCAA to stop the restrictions “immediately.”

In her argument, Moody asserted the NCAA’s actions were arbitrary, saying they would have a “chilling effect on the ability of Florida’s student athletes to discuss and negotiate fair NIL agreements.”

The multi-state lawsuit specifically alleges the NCAA imposed restrictions on a student athlete’s ability to benefit from name, image, and likeness deals.

According to Moody, the NCAA prohibits prospective student athletes from discussing NIL opportunities with schools and collectives prior to enrollment. While illegal, Moody noted the restrictions prevent Florida athletes from negotiating with collectives, reviewing NIL offers prior to enrollment, and learning about NIL-related services a school might offer.

Florida was joined by Tennessee, New York, Virginia, and the District of Columbia in the lawsuit.
