Florida court affirms Greater Miami Expressway Agency control to state

MIAMI (FLV) – A Florida court Monday ruled in favor for the Greater Miami Expressway Agency, or GMX, to maintain state control of five Miami expressways.

2nd Judicial Circuit Judge Angela Dempsey affirmed a state law passed by Gov. Ron DeSantis that disbands the Miami-Dade Expressway Authority, or MDX, and resumes operational control to the GMX over five expressways

“All of the assets, employees, contracts, rights and liabilities previously owned and controlled by the former MDX, including any accounts and/or monies maintained by the bank on behalf of MDX, have been transferred to and now are the property of GMX,” said GMX Interim Director Torey Alston in a statement to Florida’s Voice.

Per the court order, the agency now governs the expressway system within the geographical boundaries of Miami-Dade County and the portion of northeast Monroe County.

That includes County Road 94 and the portion of Monroe County bounded on the north and east by the borders of Monroe County and on the south and west by County Road 94.

Under this ruling, GMX is an agency of the state and not bound to any county’s home rule authority.

Bank of America was listed as a defendant in the case.

On July 7, the bank purportedly did not comply with GMX’s request for access and control to the accounts and monies held on behalf of the now defunct MDX – information from MDX to BOA was not initially provided. The defendants cited a need to investigate the circumstances and effect of the law as reasoning.

Procedural history on the case continued until a final ruling on Monday.

GMX asserted that its takeover will “ensure financial stability, continuity of operations, quality services, and uninterrupted employee payroll” as they serve the public of Miami-Dade and Monroe County.

“The board will will continue to work with the recently dissolved Miami-Dade Expressway Agency (MDX) organization during this compassionate transition and ensuring full transparency for the public,” Alston said.
