Florida Dept. of Education Proposing Rule for Parent Transparency About Bathrooms in Schools

TALLAHASSEE (FLV) – The Florida Department of Education is proposing a rule that would require school districts fully inform parents on how bathrooms and locker rooms are designated and supervised.

The rule aims to “ensure full transparency” for student safety and parental rights protection. The rule wants to address school district policies for parental notification about bathroom and locker room designations.

“Parents have the fundamental right to receive all education-related information pertaining to their child,” a spokesperson for the Department of Education said. “Moreover, giving parents the ability to make fully informed decisions in the interest of their child’s safety will always be a top priority for the Department.”

The rule is scheduled to be presented to the State Board of Education at the October board meeting. The rule would supersede any local school district rule.

Florida Department of Education Commissioner Manny Diaz, Jr. previously sent a letter in July telling superintendents, school board members, charter schools and private schools not to modify their practices to allow biological males into female bathrooms.

The letter came after the Biden Administration threatened to pull federal school lunch funding if schools did not follow new Title IX guidelines that are being fought in court.

“Specifically, for example, nothing in these guidance documents requires you to give biological males who identify as female access to female bathrooms, locker rooms, or dorms; to assign biological males who identify as female to female rooms on school field trips; or to allow biological males who identify as female to compete on female sports teams,” Diaz said.
