MIAMI (FLV) – A Miami judge has reportedly tossed out another voter fraud case brought to the state by Gov. Ron DeSantis.

Circuit Judge Laura Anne Stuzin concluded that statewide prosecutors didn’t have the ability to bring charges against Ronald Lee Miller.

Miller was convicted of second-degree murder in 1990 and deemed ineligible to vote, but his voter registration application was cleared by the Florida Department of State and he was able to vote in the 2020 election.

Prosecutors reportedly said Miller’s alleged crimes happened in “multiple jurisdictions because he registered to vote through a third-party voter registration organization, which sent the application to Broward County’s election supervisor, which was then sent to Tallahassee.”

Statewide prosecutors are restricted to prosecuting crimes in multiple jurisdictions under state law.

The judge ruled Miller “never physically entered Broward or Leon counties and never mailed or electronically transferred anything to either of those counties.”

“Let this be a lesson to all not to use the legal system for political gain and waste taxpayer’s hard earned money,” said Miller’s attorney, Robert Barrar.

In August, Gov. Ron DeSantis announced 20 people across the state were charged for voter fraud in the 2020 election.

The governor said those arrested voted illegally in the state because they had been convicted of either murder or sexual assault and did not have the right to vote.

A similar case was dismissed in October by a different Miami judge.

It was previously reported that Miami-Dade Circuit Judge Milton Hirsch said Robert Lee Wood, 56, “should not be prosecuted under the initiative because it did not involve multiple jurisdictions in Florida.”

The judge said the case against Wood was brought by the Office of Statewide Prosecution instead of a local state attorney.

The governor’s office previously said the administration intends to appeal Wood’s case.

“The state will continue to enforce the law and ensure that murderers and rapists who are not permitted to vote do not unlawfully do so. Florida will not be a state in which elections are left vulnerable or cheaters unaccountable,” Press Secretary Bryan Griffin previously said.
