Federal court rules Biden’s attempt to stop state tax cuts as unconstitutional, Moody celebrates

TALLAHASSEE, Fla. – Florida Attorney General Ashley Moody announced on Thursday that the U.S. Court of Appeals for the 11th Circuit denied the U.S. Department of the Treasury’s motion for a full panel review of the court’s prior decision.

At the beginning of 2023, a three-judge panel deemed it unconstitutional for the Biden administration to withhold funds from states that reduced their taxes, through the American Rescue Plan Act.

“For the third time, a federal court sided with Florida and rejected @JoeBiden’s attempt to stop our state from cutting your taxes,” she said on social media.

Alabama Attorney General Steve Marshall led a coalition of states to challenge the federal governments overreach that was being carried out through the leverage of the $1.9 trillion economic stimulus bill.

“It is astounding how many times we have had to take legal action against Biden and his administration for their illegal and perilous attempts to circumvent executive power,” Marshall said in a press release.

“Let me be clear, states have the fundamental authority to determine fiscal policies, and I will continue to defend that authority from the power hungry Biden administration,” he said.

The other states that took part in the challenge besides Florida and Alabama were West Virginia, Arkansas, Alaska, Iowa, Kansas, Montana, New Hampshire, Oklahoma, South Carolina, South Dakota and Utah.
